In accordance with the applicable European legislation, products placed on the market must comply with the requirements set out in the REACH (Registration, Evaluation, Authorisation and Restriction of Chemicals) and CLP (Classification, Labelling and Packaging) regulations.
Below you will find the information you need to understand what compliance with these regulations entails and the steps you must follow to carry out your business activities safely.
Information on the marketing of products in accordance with reach and clp regulations
The undersigned DANTE INTERNATIONAL S.A., with its registered office in Bucharest, Șos Virtuții no. 148, sector 6, with its tax domicile and correspondence address in Romania, Bucharest, sector 2, Gara Herăstrău Street, no. 6, Globalworth Square Office Building, 8th floor, registered with the Trade Register under no. J2002000372404, unique registration code 14399840, tax attribute RO, hereinafter referred to as eMAG, hereby informs you of the following information regarding your obligations in the context of marketing products containing chemicals, in accordance with:
- Regulation (EC) No. 1272/2008 of the European Parliament and of the Council of December 16, 2008 on classification, labeling, and packaging of substances and mixtures (CLP),
- Regulation (EC) No. 1907/2006 of the European Parliament and of the Council of December 18, 2006, concerning the Registration, Evaluation, Authorization, and Restriction of Chemicals (REACH),
- The marketing rules applicable on the eMAG Marketplace platform, accepted by agreeing to the Terms and Conditions.
The main purpose of the REACH and CLP Regulations
- Regulation (EC) No. 1907/2006 (REACH) – aims to ensure a high level of protection of human health and the environment from the risks posed by chemicals, by setting clear obligations for manufacturers, importers, and operators who place such substances on the European Union market.
- Regulation (EC) No. 1272/2008 (CLP) – establishes a uniform way of identifying, classifying, and communicating the hazards associated with chemical substances and mixtures, through standardized elements such as hazard pictograms, signal words, and risk phrases, ensuring the protection of workers, consumers, and the environment.
Obligation to provide the Safety data sheet
- In accordance with the obligations established by the provisions of Regulation (EC) No. 1907/2006 (REACH), the supplier of a substance or preparation shall provide the recipient of the substance or preparation with a safety data sheet in the following situations:
- when the substance or preparation is classified as hazardous;
- when the substance is persistent, bioaccumulative, and toxic or very persistent and very bioaccumulative;
- when the substance is included in the list provided for in Article 59(1) of the Regulation for reasons other than those mentioned above;
- The safety data sheet must contain the elements specified in Annex II – Guidance for the compilation of safety data sheets in the REACH Regulation, including the following:
- Identification of the substance or preparation,
- Use of the substance/preparation,
- Identification of the company responsible for placing the substance or preparation on the market,
- Clear and concise indication of hazards,
- Description of first aid measures, firefighting measures, measures in case of accidental spills, handling and storage measures,
- Relevant information on physical and chemical properties, as well as stability and reactivity.
- Characteristics: The safety data sheet must be written clearly and concisely and updated whenever new relevant information on hazards or risk management measures becomes available.
Obligation to label products in accordance with CLP
- In accordance with the obligations established by the provisions of Regulation (EC) No. 1272/2008 (CLP), economic operators must ensure that all substances and mixtures classified as hazardous are placed on the market only if they are properly labeled and packaged before being made available.
- The label must contain the elements specified in Article 17 of the CLP Regulation, including the following:
- the product identifier, the supplier’s identification details, the applicable hazard pictograms, the warning statement (“Danger” or “Warning”), the hazard statements (H phrases), the precautionary statements (P phrases), and the additional information required by the CLP Regulation, where applicable.
- Characteristics: the label must be written in the official language of the country where the substance or mixture is placed on the market.
Please note that if eMAG receives reports, notifications, or complaints regarding non-compliance with the obligations imposed by the REACH and CLP Regulations, and these prove to be justified, the products covered by those reports may be blocked from sale on the eMAG Marketplace platform.
