Starting from December 13th, 2024, the General Product Safety Regulation (GPSR) (EU) 2023/988 requires all economic operators selling products in the European Union to comply with specific requirements to ensure consumer safety and product compliance.
Main requirements
- Information about Manufacturer and Responsible Person: Sellers must provide the following details about the manufacturer or EU responsible person:
- Name,
- Address,
- Email.
- Safety information: Economic operators must ensure that all consumers are informed about potential risks associated with the products.
- Product documentation: Sellers must maintain comprehensive documentation for their products, ensuring that all necessary safety information is available.
- Product traceability: All sellers must ensure that products can be traced back to their source, facilitating accountability and safety checks.
- Labeling compliance: Products must comply with the specific labeling requirements outlined in the Regulation.
- CE Marking: Products must bear the CE mark, indicating compliance with EU safety standards.
Information required by GPSR which you must provide for your products on eMAG Marketplace:
a. Safety Information:
- These will be edited as a text field at the documentation/PNK level, similar to the product description field, and will be common to all offers attached to a PNK.
- You will be able to submit safety information according to GPSR only if you have permission to update the documentation for that product.
- If you do not have permission to update the documentation, you can request updates to the safety information for these products in the Message center, under the Product-Product information/review category.
- The completed safety information will not immediately appear in the product documentation; it will be subjected to the validation process, similar to any documentation update.
b. Details about the Manufacturer and the Responsible Person in the EU:
- To comply with legal requirements, we recommend that for each manufacturer or responsible person in the EU, you fill in all three types of information below:
- Name,
- Address,
- Email address.
- If the manufacturer is from the EU, their details may also be used for the responsible person in the EU. The details about the manufacturer and the responsible person in the EU are completed at the offer level, and once validated, they will be displayed on the site.
- You can add up to 10 sets of information for the manufacturer and the responsible person in the EU.
How you can provide the GPSR information on the eMAG Marketplace platform
You can provide the GPSR data for newly listed products or update existing ones using the API or the dedicated .XLS file named GPSR information, available in the Products-Categories section by selecting the Offer Management tab.
If you choose to use the .XLS file, it will be downloaded pre-filled with your products that require GPSR data completion and will contain columns for adding safety warnings as well as columns for details about the manufacturer and the responsible person in the EU for the products.
You can add data for up to 10 manufacturers or EU responsible persons. By updating the GPSR information using the XLS file, the details already provided about the products will be overwritten with the new information.
Therefore, we remind you that you will need to periodically check and update your product information to ensure compliance with GPSR provisions. Failure to comply may lead to products being blocked on the platform or even the suspension of activity on eMAG Marketplace until the identified issues are brought into compliance.
